Per Section 26-646 of the City Code, property owners are required to live in either the ADU or the primary dwelling on a property. This is accomplished through a two-page deed restriction which also prohibits the ADU from being sold separately from the primary dwelling. The property owner(s) will need to sign and submit the deed restriction prior to the issuance of the building permit. A sample is at the bottom of this ADU information page.
Refer to the informational handout regarding the maximum size limitations for new ADUs.
This may be the same size as the ADU (as in the case of a new detached ADU) or it may be larger if additional remodeling is required (as in the case of an interior remodel or addition to accomodate a new ADU).
